Welcome to KUADROS.COM (the “Site”). These Terms of Service govern access to, browsing, purchase and use of the Site, as well as any order placed through KUADROS.COM. By accessing, browsing or using the Site, or by placing an order, you agree to these Terms of Service, together with the policies published on the Site, including our Privacy Policy, Shipping Policy, Refund Policy and any other applicable policy.

We recommend that you read these Terms carefully before continuing. If you do not agree to these Terms, you must not use the Site or place orders on KUADROS.COM.

1. General information about KUADROS

KUADROS is an international ecommerce brand specializing in handmade oil painting reproductions on canvas. The works offered by KUADROS are not digital prints, posters, giclées or machine-made products. Each painting is handcrafted by professional artists using traditional oil painting techniques on canvas.

Unless expressly stated otherwise, paintings by KUADROS are sold unframed. In general, the artworks are shipped rolled and protected in a sturdy tube to reduce the risk of damage during international transport.

2. Use of the Site

By using this Site, you confirm that you are at least 18 years old or that you are using the Site under the supervision and authorization of a parent or legal guardian.

KUADROS grants you a limited, revocable, non-transferable and non-exclusive license to access and use the Site solely for personal purposes and to purchase products offered on KUADROS.COM. You are not authorized to use the Site for commercial purposes, resale, data scraping, mass copying, automated use or for the benefit of third parties, except with the prior written authorization of KUADROS.

KUADROS reserves the right to refuse service, cancel orders, restrict accounts or limit access to the Site when it determines, in its sole discretion, that a user's conduct violates these Terms, breaches applicable law, negatively affects other users or harms the legitimate interests of KUADROS.

3. Prohibited conduct

You agree not to use the Site to:

• Infringe copyright, trademarks, patents, trade secrets, publicity rights, privacy rights or other third-party rights.
• Post, transmit or upload false, defamatory, offensive, threatening, obscene, unlawful content, or content that may give rise to civil or criminal liability.
• Introduce viruses, malware, trojans, worms, harmful code or any element that may affect the operation of the Site.
• Interfere with the security, availability, performance or integrity of the Site.
• Use robots, scrapers, spiders, scripts, automation tools or any unauthorized data-extraction system.
• Reverse engineer, copy, reproduce, modify, distribute, resell or commercially exploit any part of the Site without the written authorization of KUADROS.

4. Accounts, passwords and security

Some features of the Site may require registration or the creation of an account. You are responsible for maintaining the confidentiality of your password, login details and account. Any activity carried out from your account will be deemed to be your responsibility, unless applicable law provides otherwise.

You must notify us immediately of any unauthorized use of your account or password, or of any possible security breach. KUADROS shall not be liable for losses arising from the unauthorized use of an account where such use results from the user’s failure to safeguard their credentials.

5. Site Information and Editorial Content

The content on the Site is provided primarily for informational, commercial, and editorial purposes. KUADROS strives to present accurate and up-to-date information, but does not guarantee that all descriptions, prices, images, editorial text, historical content, artistic data, or cultural references are free from errors, omissions, or inaccuracies.

KUADROS reserves the right to correct errors, update information, modify content, change prices, withdraw products, or cancel orders affected by technical, typographical, administrative, or availability-related errors.

6. Handcrafted Nature of the paintings

The paintings from KUADROS are handmade works. For this reason, natural variations may exist in relation to the reference image, the original work, the product photograph, or the digital preview. These variations may include differences in color, texture, proportions, brushwork, contrast, lighting, artistic interpretation, composition, or finish.

These differences are part of the handcrafted character of a handmade oil painting and are not necessarily considered defects. No handmade painting can guarantee an absolutely identical reproduction of an original work, photograph, or digital reference.

7. Screens, Colors, and Product Images

KUADROS makes every effort to display images of its products as faithfully as possible. However, the colors and details visible on a screen may vary depending on the user’s device, brightness, calibration, resolution, lighting, and settings.

In addition, because the works are painted by hand, the painting received may present natural variations compared with the images published on the Site. By purchasing from KUADROS, you acknowledge that a handmade oil reproduction is not a digital print or an exact mechanical copy.

8. Orders, Acceptance, and Cancellation by KUADROS

Placing an order does not constitute automatic acceptance by KUADROS. We reserve the right to accept, reject, limit, or cancel any order for reasonable grounds, including pricing errors, product errors, lack of availability, suspicion of fraud, payment issues, logistical limitations, legal restrictions, inability to produce the item, or any other circumstance that prevents the order from being processed properly.

If KUADROS cancels an order after payment has been received, the corresponding amount will be refunded using the original payment method, unless another permitted method is agreed or applicable law provides otherwise.

9. Made-to-Order and Personalized Products

The paintings of KUADROS are produced individually after the order is received. Therefore, they are considered made-to-order products and, in many cases, personalized products or items made to the customer’s specifications.

The process may include artist assignment, preparation of materials, composition planning, painting work, quality control, preview photography, reasonable adjustments and preparation for shipping. Once this process has begun, KUADROS incurs production, material, coordination and artistic time costs.

10. Production start and customer cancellations

The customer may request cancellation of an order before the painting has been assigned to an artist or before the production process has begun. If the order has not yet entered production, KUADROS may cancel the order and issue a full refund.

Once the painting has been assigned to an artist, prepared, started, painted, adjusted or completed, the order will be deemed to be in production and cannot be automatically cancelled due to a change of mind, unless applicable law provides otherwise.

Before shipping, KUADROS will continue to offer the customer the option to review the final preview and request reasonable adjustments, in accordance with these Terms and the applicable Refund Policy.

11. Preview, approval and adjustments before shipping

Before sending a painting, KUADROS may provide the customer with a photograph of the finished work for review. The painting will not be shipped until the final preview has been approved by the customer or until any approval procedure indicated by KUADROS has been completed.

If the customer considers that the painting requires corrections, they may request reasonable adjustments before shipping. These adjustments may include corrections to colour, proportion, detail, contrast, composition, finish or artistic interpretation, always within the natural limits of a handmade painting.

Changes that completely alter the composition, style, format, size or original instructions of the order may not be considered reasonable adjustments and may require special review, an additional cost or a new order.

Approval of the final preview means that the customer accepts the painting as shown in the image sent for approval, taking into account normal variations in photography, lighting, screen display and the handcrafted nature of oil on canvas.

12. After approval and shipping

Once the final preview has been approved and the painting has been shipped, no cancellations, returns or refunds for change of mind are accepted on paintings made to order, customised or produced according to the customer’s specifications, except where applicable law provides otherwise.

This does not affect the customer’s rights in the event of damage during transport, material defect, order error, incorrect product or legally applicable lack of conformity.

13. Returns and refunds

Returns and refunds are governed by the Refund Policy published on the Site, as well as by these Terms and applicable law.

When a return is accepted, the product must be in the same condition in which it was received, unused, unaltered, not hung, undamaged and not handled beyond what is necessary to inspect it. It must also be returned in its original packaging or in packaging that is equally secure and suitable for artworks.

When a return is accepted due to a change of mind or the valid exercise of a statutory right of withdrawal, the customer will be responsible for the direct costs of return shipping, unless KUADROS expressly states otherwise or applicable law provides otherwise. something.

The customer must use a secure shipping method, preferably with tracking. KUADROS will not be responsible for products lost or damaged during return shipping arranged by the customer.

Where a refund is due, it will be issued using the same payment method used for the original purchase, unless another permitted method is expressly agreed. KUADROS may wait to receive the returned product or valid proof of return before processing the refund, where permitted by applicable law.

No additional costs arising from special, express, or upgraded shipping methods beyond standard shipping will be refunded, unless applicable law provides otherwise.

14. Right of withdrawal for European Union consumers

Consumers in the European Union may have the right to withdraw from an online purchase within the applicable legal period. However, European law includes exceptions, including products made to the consumer's specifications or clearly personalized items.

Due to the nature of the paintings by KUADROS, many works may be excluded from the right of withdrawal once they have been ordered, assigned to an artist, produced, adjusted, approved, or shipped, as they are made-to-order, personalized, or produced according to the customer's specifications.

When an electronic withdrawal function is available on the Site, the automatic acknowledgement of receipt of a request only confirms that KUADROS has received that request. It does not mean that the order is automatically refundable if the painting is excluded from the right of withdrawal or if it does not meet the applicable legal or contractual conditions.

15. Incorrect products, defects, or transit damage

If you receive the wrong painting, the wrong size, a work that does not match the approved order, or a product damaged in transit, you must contact KUADROS as soon as possible and include clear photographs of the painting, outer packaging, inner packaging, order number, and a description of the issue.

We recommend reporting transit damage within 7 days of delivery so the case can be handled properly with the carrier. This deadline does not limit any mandatory legal rights that may apply to the customer.

Where applicable, KUADROS may offer an appropriate solution, which may include correction, replacement, a new painting, store credit, partial refund, or full refund, depending on the case and applicable law.

16. International shipping, packaging, and import taxes

KUADROS ships internationally using recognized carriers, subject to availability, destination, and order conditions. Delivery times may vary depending on the country, shipping carrier, season, customs processes, inspections, weather conditions, strikes, logistical restrictions, or other circumstances beyond the direct control of KUADROS.

Under normal conditions, KUADROS prepays and covers the applicable import taxes for the paintings, so the customer does not have to pay those taxes upon receiving the order.

However, although KUADROS covers the import taxes for the paintings, some customs authorities, carriers, or local entities may apply administrative charges, handling fees, processing, storage, inspection, data correction, brokerage, or other local charges that are not part of the prepaid import tax by KUADROS.

These extraordinary charges depend on local rules and practices and, where applicable, may be claimed directly by customs, the carrier, or the relevant local authority. KUADROS does not control such extraordinary local charges.

If you receive a notice related to customs, taxes, or local charges, please contact KUADROS before making any payment whenever possible. Please send us a copy of the notice, the tracking number, and the order number so we can review the case.

Unclaimed paintings, abandoned in customs, or whose import is not completed due to the customer’s failure to respond, provide documentation, or cooperate may be subject to refund exclusions, additional costs, or loss of the product, unless applicable law provides otherwise.

17. Export policy and international legal compliance

By purchasing from KUADROS.COM, you acknowledge that the products may be subject to import, export, customs, sanctions, trade restrictions, and other applicable laws in the country of origin, destination, or transit.

You agree to comply with all applicable laws and regulations related to the purchase, import, receipt, and use of the products purchased at KUADROS.COM.

18. Quantity limits and prohibition of unauthorized resale

KUADROS reserves the right to limit the quantity of products purchased by the same person, account, card, billing address, shipping address, household, or order.

Unless expressly authorized in writing by KUADROS, it is not permitted to purchase products from KUADROS.COM for commercial resale to third parties.

19. Copyright, trademarks, and intellectual property of the Site

All content on the Site, including text, designs, logos, graphics, photographs, images, trade names, trademarks, interfaces, code, structure, and the selection and arrangement of content, belongs to KUADROS or its licensors, suppliers, partners, or respective rights holders, and is protected by applicable intellectual property laws.

KUADROS, KUADROS.COM, its logos, names, distinctive signs, designs, and brand elements are the property of KUADROS or are used with authorization. Access to the Site does not grant any license, transfer, or right to use such elements.

You may not copy, reproduce, modify, distribute, display, sell, license, exploit, or use any content from the Site without the prior written authorization of KUADROS or the corresponding rights holder.

20. Images of paintings, public domain, and permissions

KUADROS offers reproductions of paintings that, to the best of our understanding, are in the public domain, available under license, or may be legally reproduced in accordance with applicable rules. KUADROS may also offer custom paintings based on images provided by the customer.

If you believe that any image, artwork, reference, or content published on the Site infringes copyright, trademarks, image rights, or other intellectual property rights, please contact us with the relevant information so that we may review the matter. Where appropriate, KUADROS will remove or modify the affected content.

By submitting images, photographs, artworks, references, or instructions for a custom order, you declare that you own the necessary rights, licenses, or authorizations to use such images and to commission us to create the requested painting. You will be responsible for any claim arising from images or instructions provided by you.

21. Comments, reviews, and user-submitted content

If you submit reviews, comments, photographs, suggestions, text, images, or other content to KUADROS or the Site, you declare that you have the right to do so and that such content does not infringe any third-party rights or applicable laws.

Unless otherwise required by applicable law, you grant KUADROS a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, translate, display, distribute, and communicate such content for commercial, promotional, operational, editorial, or customer service purposes.

KUADROS may, but is not obliged to, review, edit, refuse, or remove user-submitted content when it considers that it violates these Terms, applicable law, or the legitimate interests of KUADROS.

22. Privacy

Your use of KUADROS.COM is also subject to our Privacy Policy. We encourage you to review it to understand how we collect, use, protect, and manage personal information.

23. Site Security

You are prohibited from attempting to breach the Site’s security, accessing data not intended for you, accessing servers or accounts without authorization, scanning for vulnerabilities, interfering with the service, overloading systems, sending spam, introducing malware, or falsifying technical information.

KUADROS reserves the right to investigate suspicious activity and cooperate with authorities, technical providers, or legal advisors when necessary.

24. Crawling, scraping, and automated use

Crawling of the Site is permitted only when carried out in accordance with our robots.txt file and for legitimate indexing purposes. Scraping, bulk data extraction, automated copying of content, or the collection of prices, images, text, or commercial information without written authorization from KUADROS is prohibited.

25. Links to other sites

The Site may contain links to external pages. KUADROS does not control and is not responsible for the content, products, services, policies, availability, or privacy practices of third-party websites. Use of external links is at your own risk.

26. Typographical errors, prices, and incorrect information

In the event of a typographical error, pricing error, description error, technical error, or incorrect product information, KUADROS reserves the right to correct the error, refuse the order, or cancel it, even if the order has already been confirmed.

If the order is canceled after payment has been processed, KUADROS will refund the corresponding amount using the original payment method, unless another permitted method is agreed upon or applicable law provides otherwise.

27. Service interruptions

KUADROS does not guarantee that the Site will be available without interruption, securely, or error-free. The Site may be temporarily unavailable due to maintenance, technical failures, network outages, software errors, system overloads, cyberattacks, supplier failures, legal restrictions, force majeure events, or other circumstances beyond our reasonable control.

28. Limitation of Liability

To the fullest extent permitted by applicable law, KUADROS shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, loss of profits, loss of data, loss of business opportunities, or damages arising from the use or inability to use the Site or products purchased on the Site.

To the extent permitted by applicable law, KUADROS’s total liability to you for any claim relating to an order shall not exceed the amount actually paid for the product that is the subject of the claim.

Nothing in these Terms limits mandatory consumer rights that cannot be excluded or limited under applicable law.

29. Site Warranty Disclaimer

The Site and its content are provided “as is” and “as available.” KUADROS does not guarantee that the Site will be free of errors, interruptions, inaccuracies, vulnerabilities, or technical defects.

The descriptions, images, artistic references, and editorial text are provided for informational and commercial purposes. The handmade nature of the paintings means that each work may present natural variations from images, references, or original paintings.

30. Indemnification

You agree to defend, indemnify, and hold harmless KUADROS, its directors, employees, contractors, collaborators, affiliates, suppliers, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the Site, breach of these Terms, infringement of third-party rights, content provided by you, or non-compliance with applicable law.

31. Termination or Restriction of Access

KUADROS may suspend, restrict, or terminate your access to the Site or your account, without prior notice, when it considers that you have violated these Terms, applicable law, or the legitimate interests of KUADROS.

Termination shall not affect any rights or obligations arising before termination, including payment obligations, limitations of liability, intellectual property rights, indemnities, and clauses that by their nature must survive.

32. Legal Remedies

You acknowledge that certain breaches of these Terms, especially those related to intellectual property, security, unauthorized use of the Site, or data extraction, may cause irreparable harm to KUADROS. In such cases, KUADROS may seek injunctive relief, specific performance, or other available legal remedies, in addition to any applicable compensation.

33. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Israel, without prejudice to any mandatory consumer protection rules that may apply in the consumer’s jurisdiction of residence.

34. Jurisdiction and Dispute Resolution

Unless otherwise required by applicable law, any dispute relating to the use of the Site, these Terms, or products purchased on KUADROS.COM shall be subject to the competent jurisdiction of the State of Israel.

Nothing in this clause limits any mandatory rights that may apply to consumers under applicable consumer protection laws.

35. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

36. No waiver

KUADROS’s failure or delay in exercising any right or remedy shall not constitute a waiver of that right or remedy. Any waiver must be in writing to be effective.

37. Entire agreement

These Terms, together with the policies published on KUADROS.COM, constitute the entire agreement between you and KUADROS regarding use of the Site and the purchase of products, superseding any prior communication or agreement relating to those matters.

38. Changes

KUADROS reserves the right to modify, update, or replace these Terms at any time. Changes will take effect upon publication on the Site, unless a different date is stated. Continued use of the Site after changes are published implies acceptance of the revised Terms.
